Welcome to Bica Nutrition ("Bica", "we", "our", or "us").

These Terms of Use ("Terms") govern your access to and use of the Bica Nutrition Companion, including our website, web platform, AI-powered services, and any related features (collectively, the "Platform").

By creating an account or using the Platform, you confirm that you have read, understood, and agree to these Terms. If you do not agree with these Terms, you must not access or use the Platform.

1. About Bica

Bica is an AI-powered nutrition companion designed to help users better understand their eating habits, establish nutrition goals, track food intake, and receive educational feedback, insights, and suggestions to support healthier lifestyle choices.

The Platform is intended to promote awareness and understanding of nutrition through interactive AI-powered experiences. While Bica aims to provide helpful guidance, it does not replace qualified healthcare professionals and should never be considered a substitute for professional medical or nutritional advice.

The Platform is continuously evolving and new features, improvements, and services may be introduced over time.

2. Eligibility and Your Account

To use the Platform, you must be at least 16 years of age and legally capable of entering into these Terms.

When creating an account, you agree to provide accurate and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account.

If you believe your account has been accessed without your authorization, you should notify us immediately.

3. Beta Service

Bica is currently provided as a Beta service.

By using the Platform during this stage, you acknowledge that certain features may still be under development and that occasional issues may occur. Features may change, become unavailable, produce unexpected results, or be removed without prior notice as we continue improving the Platform.

Although we work continuously to improve reliability and performance, we cannot guarantee uninterrupted availability or error-free operation while the Platform remains in Beta.

4. AI-Powered Services

The Platform uses artificial intelligence to provide conversations, nutritional insights, educational feedback, recommendations, summaries, and other interactive experiences. These services rely on a combination of Bica's own systems and trusted third-party providers.

Artificial intelligence is an evolving technology and its responses are generated automatically. While we strive to provide accurate and useful information, AI-generated content may occasionally be inaccurate, incomplete, outdated, inconsistent, or inappropriate for your specific circumstances.

The Platform may misunderstand user input, incorrectly estimate nutritional values, or generate responses that should not be relied upon as factual or professional advice.

You acknowledge that AI-generated information is intended solely for educational purposes and should always be evaluated using your own judgment.

5. Medical & AI Disclaimer

Bica is designed exclusively for educational and informational purposes.

The Platform does not provide medical advice, nutritional therapy, diagnosis, treatment, or healthcare services, nor does it replace the advice of physicians, registered dietitians, nutritionists, psychologists, or other qualified healthcare professionals.

Information provided through the Platform, including AI-generated recommendations, nutritional estimates, meal feedback, calorie calculations, dietary suggestions, and health-related insights, should never be interpreted as professional advice or as the basis for making medical decisions.

You should always consult an appropriately qualified healthcare professional before making significant dietary or lifestyle changes, particularly if you have allergies, chronic illnesses, medical conditions, eating disorders, are pregnant or breastfeeding, take medication, or have any other health concerns.

If you believe you are experiencing a medical emergency, contact your local emergency services immediately rather than relying on the Platform.

6. Your Responsibilities

You are solely responsible for the information you provide to Bica and for any decisions you make based on the content generated by the Platform.

This includes, without limitation, the accuracy of your food logs, personal information, nutrition goals, body measurements, dietary preferences, and any other information submitted through your account.

While Bica aims to provide helpful educational guidance, we cannot verify the accuracy of the information you provide or determine whether our suggestions are appropriate for your individual circumstances.

You remain entirely responsible for your own nutritional choices, health decisions, allergies, dietary restrictions, exercise routines, and overall wellbeing. Any actions you take based on information provided by the Platform are taken entirely at your own risk.

7. Acceptable Use

You agree to use the Platform responsibly and in accordance with applicable laws.

You must not attempt to interfere with the operation or security of the Platform, gain unauthorized access to our systems, reverse engineer the software, distribute malicious code, impersonate another person, or use the Platform for unlawful or fraudulent purposes.

We reserve the right to suspend or terminate accounts that violate these Terms or that compromise the security, integrity, or availability of the Platform.

8. User Content

The information you submit to the Platform, including conversations, food logs, nutrition goals, preferences, and other account content, remains your property.

By using Bica, you grant us a limited, non-exclusive, worldwide license to process and use this information solely for the purposes of providing the Platform, improving our services, maintaining security, complying with legal obligations, and developing new features.

We do not sell your personally identifiable information, including your name or email address, to third parties for advertising or commercial purposes.

We may use anonymized, aggregated, or non-identifiable information to improve our services, perform analytics, develop new products, conduct research, and support the growth and promotion of the Bica brand.

9. Subscriptions, Billing and Refunds

Certain features of the Platform may require an active paid subscription.

Subscription payments are securely processed through Stripe and renew automatically unless cancelled before the next billing period.

You may manage, modify, or cancel your subscription at any time through your account settings. Unless otherwise required by applicable law, cancellation becomes effective at the end of the current billing period.

Refunds may be granted where a paid subscription has not been used. For the purposes of these Terms, a subscription is considered used once premium functionality has been accessed, including AI interactions or other subscription-exclusive features. Once premium features have been used, refunds will generally not be issued except where required by applicable consumer protection laws.

10. Availability of the Platform

We strive to provide a reliable service but cannot guarantee uninterrupted availability.

The Platform may occasionally become unavailable due to maintenance, software updates, technical issues, security incidents, third-party service interruptions, or circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.

11. Intellectual Property

All intellectual property rights relating to the Platform remain the exclusive property of Bica Nutrition or its licensors.

This includes, without limitation, the Bica name, branding, logos, interface design, software, source code, graphics, illustrations, documentation, AI prompts, original content, and any other materials made available through the Platform.

Nothing contained in these Terms grants you ownership of any intellectual property belonging to Bica.

12. Third-Party Services

The Platform relies on trusted third-party providers to deliver certain services, including artificial intelligence, cloud hosting, payment processing, authentication, analytics, and other technical infrastructure.

These providers operate under their own terms and privacy policies. While we carefully select our partners, we are not responsible for the content, availability, or practices of third-party services.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Bica Nutrition shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform.

This includes, without limitation, any health outcomes, nutritional deficiencies, allergic reactions, dietary decisions, exercise results, weight changes, reliance on AI-generated information, interruptions of service, loss of data, technical failures, or inaccuracies contained within the Platform.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the Platform will always be available, uninterrupted, secure, error-free, or suitable for your individual needs.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.

14. Changes to the Platform and These Terms

We may update, improve, modify, or discontinue features of the Platform at any time as part of our ongoing development.

We may also update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Where changes are significant, we will provide appropriate notice through the Platform or by email where reasonably possible.

Your continued use of the Platform after updated Terms become effective constitutes acceptance of those changes.

15. Governing Law

These Terms are governed by the laws of Portugal.

If you are located within the European Union, nothing in these Terms limits any mandatory consumer rights that apply under the laws of your country of residence.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Portugal, unless otherwise required by applicable consumer protection legislation.

16. Force Majeure

Bica Nutrition shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control. These events may include, but are not limited to, natural disasters, pandemics, governmental actions, war, civil unrest, labour disputes, internet or telecommunications failures, cyberattacks, power outages, failures of third-party service providers, cloud infrastructure outages, or any other circumstances that could not reasonably have been anticipated or prevented.

During such events, our obligations under these Terms shall be suspended for the duration of the event. We will make reasonable efforts to restore normal operation of the Platform as soon as practicable.

17. Entire Agreement and Severability

These Terms constitute the entire agreement between you and Bica Nutrition regarding your use of the Platform and supersede any prior agreements, understandings, communications, or representations relating to the same subject matter.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court or competent authority, that provision shall be interpreted to the maximum extent permitted by applicable law. If it cannot be so interpreted, it shall be deemed severed from these Terms without affecting the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

Failure by Bica Nutrition to enforce any provision of these Terms shall not be considered a waiver of any rights or remedies available to us under these Terms or applicable law.
